Rental Agreement Offer for Tourist Real Estate in Montenegro
1. General Provisions
1.1. This document constitutes a public offer (“Offer”) for entering into a rental agreement for tourist real estate (“Agreement”), published in accordance with the Consumer Protection Act and the Civil Code of Montenegro.
1.2. The Offer is made on behalf of “2MONTENEGRO” DOO KOTOR, Skaljari BB, Kotor, Montenegro (“Lessor”).
1.3. By making a reservation or prepayment, or taking any action indicating an intent to use the rental service, a natural person (“Lessee”) confirms their full and unconditional acceptance of this Offer.
1.4. The Agreement is legally binding in written form without requiring a physical signature, in line with Montenegrin and international civil law practice.
2. Rental Terms and Payment Procedure
2.1. Rental Object and Price
2.1.1. The rental object, price, duration, and specific terms are set forth in the booking confirmation, which forms an integral part of this Offer.
2.2. Payment Terms
- 2.2.1. The Lessee agrees to pay 100% of the agreed rental price unless otherwise agreed in writing. The amount is final and non-negotiable after check-in.
- 2.2.2. As per Montenegro’s Law on Financial Obligations, the standard payment period is 30 calendar days from invoicing unless otherwise specified.
- 2.2.3. This Offer establishes a stricter term: full payment must be completed no later than check-in. Key handover occurs only after full payment.
- 2.2.4. If a partial prepayment was agreed (e.g., 50%), the remaining amount is due at check-in, but in all cases before the end of the rental period.
- 2.2.5. Late, partial, or missed payments constitute a breach of the Agreement. The Lessor reserves the right to apply penalties, deny access, and pursue debt collection, including through legal or international channels.
3. Responsibilities of the Parties
- 3.1. In the case of non-payment or early departure without settlement, the Lessor may: contact authorities, initiate debt recovery, and blacklist the Lessee.
- 3.2. The Lessee is responsible for property damage, breach of house rules, and any material or reputational damage caused to the Lessor.
4. Governing Law and Dispute Resolution
- 4.1. This Offer is governed by Montenegrin law, including the Residential Lease Act, Consumer Protection Act, Civil Code, and Law on Financial Obligations.
- 4.2. Disputes shall be resolved by competent courts in Montenegro at the Lessor’s place of registration.
- 4.3. By booking or paying, the Lessee agrees to the Offer’s terms, including payment obligations and liability.
- 4.4. In all matters not expressly regulated by this Offer, the applicable provisions of Montenegrin legislation governing real estate rental and civil-law relations shall apply.
5. Final Provisions
5.1. This Offer is published electronically and available on the website or upon email request.
5.2. The Lessor reserves the right to amend this Offer without notice. Changes take effect upon publication.
